Are there laws prohibiting a person from wearing spiked bracelets in Canada?
I usually wear leather bracelets with metal spikes on them, and I have been harassed by the police about it. They make me remove them before entering any government building and they have even threatened to confiscate them. Is there an actual written law that prohibits people from wearing spiked wristbands in Canada?
It is not covered directly under the Criminal Code of Canada. In the Criminal Code it states the definition of a prohibited weapon is
“(a) a knife that has a blade that opens automatically by gravity or centrifugal force or by hand pressure applied to a button, spring or other device in or attached to the handle of the knife, or
(b) any weapon, other than a firearm, that is prescribed to be a prohibited weapon;”
If you check the “Regulations Prescribing Certain Firearms and other Weapons, Components and Parts of Weapons, Accessories, Cartridge Magazines, Ammunition and Projectiles as Prohibited or Restricted”, section 11 states :
“The device commonly known as a “Spiked Wristband”, being a wristband to which a spike or blade is affixed, and any similar device.”
Section 88(1) of the Criminal Code reads
“Every person commits an offence who carries or possesses a weapon, an imitation of a weapon, a prohibited device or any ammunition or prohibited ammunition for a purpose dangerous to the public peace or for the purpose of committing an offence.”
So wearing it may not be an offence in itself. However, there are other restrictions.
Section 89. (1) Every person commits an offence who, without lawful excuse, carries a weapon, a prohibited device or any ammunition or prohibited ammunition while the person is attending or is on the way to attend a public meeting.
Then there is also the issue of it being concealed (section 90(1) ).
Bottom line is that they can request you remove it if entering their building as it is considered a weapon. And depending on the situation, it may be illegal to possess.
